We provide comprehensive AI automation solutions designed to meet every HVAC contractor's needs. Whether you're looking for a new system installation, repair, or regular maintenance, our team is here to deliver solutions that optimize your heating, ventilation, and air conditioning systems.

These Terms of Service (“Terms”) govern your access to and use of the Smart Tradesman Solutions website, platform, software, services, and related tools (collectively, the “Services”).

By accessing or using the Services, you (“Client,” “you,” or “your”) agree to be legally bound by these Terms.

If you do not agree, do not use the Services.

Smart Tradesman Solutions (“Company,” “we,” “us,” or “our”) provides AI-powered automation and communication services designed for HVAC contractors and service businesses.


1. Services Provided

Smart Tradesman Solutions provides software installation, automation systems, and communication tools including but not limited to:

• Customer reactivation automation
• Google review request automation
• AI call answering and routing
• SMS messaging automation
• Lead capture and follow-up automation
• Appointment booking automation
• CRM access and dashboard tools
• Campaign installation and configuration
• Website chatbot and communication tools

Services may include free installation promotions or paid subscription services.

We reserve the right to modify, improve, suspend, or discontinue any Services at any time without notice.


2. Free Installation Services

We may offer free installation of automation campaigns, including Customer Reactivation and Review Booster systems.

Free installation refers only to the setup and configuration of automation systems.

Client is responsible for all ongoing operational costs including but not limited to:

• SMS messaging costs
• Phone number costs
• Telecommunications provider fees
• Platform subscription fees (if applicable)

A dedicated SMS-enabled business phone line may be required. This phone line typically costs approximately $10 per month and is billed separately by telecommunications providers.

Smart Tradesman Solutions does not control telecommunications fees and is not responsible for such charges.


3. Client Responsibilities

Client agrees to:

• Provide accurate business and account information
• Provide lawful customer contact data
• Obtain proper consent before contacting customers
• Comply with all applicable communication and privacy laws
• Use the Services only for lawful business purposes

Client is solely responsible for the accuracy and legality of all customer data provided.


4. Account Access and Security

Client is responsible for maintaining:

• Account login credentials
• Account security
• Accuracy of account information

Client is responsible for all activity conducted under their account.

We reserve the right to suspend or terminate accounts for violations of these Terms.


5. Fees, Usage & Access

Plans and Fees

Smart Tradesman Solutions offers the following plans:

Launch Plan
$997 one-time setup fee and $127 per month.

Growth Plan (Best Value)
$1,997 one-time setup fee and $197 per month.

Domination Plan (Premium)
$2,997 one-time setup fee and $597 per month.

The setup fee covers system configuration, onboarding, and activation.

Monthly fees provide ongoing access to the Services.

All fees are in USD.


Promotional Pricing and Special Offers

Promotional pricing, discounts, coupons, or special offers may be provided.

These promotional offers:

• Are temporary
• May be withdrawn at any time
• Do not guarantee permanent pricing
• Do not apply to future billing unless explicitly stated

Standard pricing may apply after promotional periods expire.


Billing

Subscriptions are billed monthly in advance.

Client authorizes Smart Tradesman Solutions to automatically charge the payment method on file.

Failure to pay may result in service suspension or termination.

All payments are non-refundable unless explicitly stated otherwise.


Price Changes

Smart Tradesman Solutions reserves the right to modify, increase, or adjust pricing at any time.

Pricing changes may apply immediately to new clients and may apply to existing clients upon renewal or notice.

Special promotional pricing and launch offers are excluded from standard pricing and may be modified or discontinued at any time.

Continued use of Services constitutes acceptance of updated pricing.


Telecommunications and SMS Fees

SMS messaging, phone numbers, and telecommunications services may incur separate charges from third-party providers.

Client is solely responsible for telecommunications charges.

Smart Tradesman Solutions does not control and is not responsible for telecommunications fees.


Access

Access begins upon system activation.

We do not guarantee uninterrupted or continuous service availability.


6. No Refund Policy

All setup fees and subscription fees are non-refundable.

Due to the digital nature of the Services and system configuration work, refunds are not provided once Services begin.


7. No Guarantee of Results

Smart Tradesman Solutions does not guarantee:

• Lead generation
• Revenue increases
• Customer responses
• Booked appointments
• Business growth

Results depend on many external factors beyond our control.


8. SMS Messaging Compliance and Client Responsibility

Client is solely responsible for ensuring proper consent has been obtained before sending SMS messages.

Client agrees to comply with all applicable messaging laws, including but not limited to:

• Telephone Consumer Protection Act (TCPA)
• CAN-SPAM Act
• CTIA Messaging Guidelines
• Carrier messaging policies

Smart Tradesman Solutions acts only as a technology provider.

Client agrees to indemnify Smart Tradesman Solutions against any claims arising from Client messaging activities.


9. Telecommunications Disclaimer

Services rely on third-party telecommunications providers.

We do not guarantee:

• Message delivery
• Call delivery
• Carrier availability

Carriers may block or delay messages.

We are not responsible for telecommunications provider actions.


10. Acceptable Use Policy

Client agrees not to use Services for:

• Spam
• Illegal communications
• Fraudulent activities
• Harassment
• Unauthorized marketing

Violation may result in immediate termination.


11. Third-Party Services

Services may integrate with third-party platforms including:

• Telecommunications providers
• Payment processors
• CRM platforms
• Hosting providers

We are not responsible for third-party outages or failures.


12. Limitation of Liability

To the maximum extent permitted by law, Smart Tradesman Solutions shall not be liable for:

• Lost profits
• Lost revenue
• Business interruption
• Indirect damages
• Consequential damages

Maximum liability shall not exceed the amount paid in the previous 3 months.


13. Indemnification

Client agrees to indemnify and hold harmless Smart Tradesman Solutions from any claims arising from:

• Client use of Services
• Client messaging activities
• Client violation of laws
• Client misuse of Services


14. Chargebacks and Payment Disputes

Client agrees not to initiate chargebacks without first contacting us.

Fraudulent chargebacks may result in termination and legal action.

Client is responsible for chargeback fees.


15. Termination

We may suspend or terminate Services for:

• Non-payment
• Violation of Terms
• Abuse of Services

Client may cancel at any time. No refunds will be provided.


16. Intellectual Property

All systems, software, automation workflows, and materials remain the property of Smart Tradesman Solutions.

Client may not copy, resell, or distribute our systems.


17. Changes to Terms

We reserve the right to update these Terms at any time.

Continued use constitutes acceptance.
